These Terms of Use ("Terms") govern your access to and use of reviz.design, including our website, web application, AI-powered workflows, image generation tools, editing tools, enhancement tools, APIs, beta features, account areas, payment flows, support services, and any related software, content, documentation, or services (collectively, the "Service").
The Service is operated by Bengi Kirici, located at Stralauer Platz 37, 10243 Berlin, Germany ("reviz.design", "we", "us", or "our").

By accessing or using the Service, creating an account, purchasing credits, starting a subscription, uploading content, or generating outputs, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Service.
1.1. These Terms apply to all users of the Service, including individuals, freelancers, consumers, companies, agencies, studios, architecture offices, interior designers, real estate professionals, furniture brands, developers, and other organizations.
1.2. If you use the Service on behalf of a company, studio, agency, employer, client, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms. In that case, "you" refers both to you and to that entity.
1.3. Additional terms may apply to specific features, subscriptions, API access, enterprise accounts, beta features, third-party model providers, or payment flows. If additional terms apply, they will become part of your agreement with us.
1.4. If these Terms conflict with a signed agreement between you and reviz.design, the signed agreement will control to the extent of the conflict.
2.1. reviz.design provides AI-powered tools for visual workflows, including but not limited to:
2.2. The Service allows users to upload, submit, generate, edit, transform, enhance, and export visual content.
2.3. The Service is a software and visualization tool. It is not a substitute for professional judgment, technical verification, legal review, architectural approval, engineering assessment, construction documentation, real estate disclosure, or regulatory compliance review.
2.4. We may modify, improve, suspend, discontinue, restrict, or remove any feature of the Service at any time.
3.1. You must be at least 18 years old or otherwise have full legal capacity under applicable law to enter into these Terms.
3.2. If you are under 18, you may not use the Service unless your parent or legal guardian has reviewed and accepted these Terms on your behalf, where permitted by applicable law.
3.3. You may not use the Service if you are legally prohibited from doing so, if you are subject to applicable sanctions restrictions, or if your use would violate applicable export control laws or other regulations.
4.1. Certain features require an account.
4.2. You agree to provide accurate, complete, and current information when creating or using your account.
4.3. You are responsible for keeping your login credentials, passwords, API keys, access tokens, and account information confidential.
4.4. You are responsible for all activity under your account, including activity by employees, contractors, collaborators, team members, clients, or anyone else you authorize or allow to access the Service.
4.5. You must notify us immediately at contact@reviz.design if you suspect unauthorized access, credential theft, account compromise, data leakage, or any other security incident.
4.6. We may suspend, restrict, or terminate your account if we reasonably believe that your account has been compromised, used unlawfully, used abusively, or used in violation of these Terms.
5.1. If the Service allows team or organization accounts, account administrators may invite users, remove users, assign roles, manage billing, access usage information, and control workspace settings.
5.2. You are responsible for ensuring that all invited users comply with these Terms.
5.3. We may rely on instructions from account administrators and are not responsible for internal disputes between team members, clients, contractors, or organizations.
6.1. Certain features of the Service may require payment, credits, subscriptions, usage-based fees, or other charges.
6.2. Prices, plan details, credit amounts, renewal periods, usage limits, and taxes are shown on the relevant pricing, checkout, or billing pages.
6.3. Payments are due immediately unless otherwise stated.
6.4. Payments may be processed by third-party payment providers such as Stripe. We do not store your full payment card details.
6.5. Credits may be consumed when you use certain tools, generate outputs, process images, upscale files, or access paid workflows.
6.6. Unless expressly stated otherwise, credits are non-refundable, non-transferable, have no cash value, and may expire according to the rules shown at purchase.
6.7. Subscription plans renew automatically for the selected billing period unless cancelled before renewal through the available billing interface.
6.8. Cancelling a subscription stops future renewals but does not automatically refund fees already paid, unless required by law.
6.9. We may change prices, credit rules, plan limits, or subscription features for future billing periods or future purchases.
6.10. If payment fails, if a chargeback occurs, or if your account has overdue amounts, we may suspend or restrict access to paid features.
7.1. If you are a consumer located in the European Union, you may have a statutory right of withdrawal.
7.2. By purchasing digital services, credits, or subscriptions and requesting immediate access or immediate performance, you acknowledge that the Service may begin before the withdrawal period expires.
7.3. If digital content or digital services are fully performed or made available immediately with your prior express consent, your right of withdrawal may expire or be limited according to applicable law.
7.4. Nothing in these Terms limits mandatory consumer rights that cannot legally be excluded.
8.1. "Input" means any content, data, prompt, image, photo, sketch, drawing, floor plan, building image, room photo, product image, reference image, style reference, mask, file, text, instruction, metadata, or other material that you upload, submit, provide, or make available through the Service.
8.2. "Output" means any image, render, visualization, edit, variation, enhancement, upscaled image, preview, generated file, or other result produced or returned by the Service.
8.3. "User Content" means Inputs and Outputs together.
8.4. You retain ownership of your Inputs, subject to the rights granted to us in these Terms.
8.5. You are solely responsible for all Inputs you upload, submit, or provide.
8.6. You represent and warrant that you have all necessary rights, licenses, permissions, consents, releases, and legal bases to upload, submit, process, transform, generate from, and use your Inputs with the Service.
8.7. This includes, without limitation, rights relating to:
8.8. You must not upload or use Inputs that violate any law, infringe any third-party rights, breach confidentiality obligations, violate privacy or data protection laws, or contain content that you are not authorized to use.
9.1. You grant reviz.design a worldwide, non-exclusive, limited license to host, store, process, reproduce, transmit, display, modify, transform, and use your User Content solely as necessary to:
9.2. This license continues for as long as necessary to provide the Service, comply with law, maintain security, resolve disputes, or enforce our rights.
9.3. We do not claim ownership of your Inputs.
10.1. As between you and reviz.design, and to the extent permitted by applicable law and applicable third-party provider terms, you may use Outputs for personal or commercial purposes.
10.2. Your use of Outputs remains subject to:
10.3. reviz.design does not guarantee that Outputs are unique, original, non-infringing, accurate, legally usable, commercially safe, or suitable for any specific purpose.
10.4. Similar or identical Outputs may be generated for other users.
10.5. You are solely responsible for reviewing, clearing, verifying, labeling, and approving Outputs before using, publishing, selling, presenting, exporting, delivering to clients, uploading to listings, or otherwise relying on them.
11.1. You do not receive any ownership rights or licenses in:
11.2. You may not copy, resell, sublicense, reverse engineer, scrape, reproduce, modify, or create derivative works from the Service except as expressly permitted by us.
12.1. The Service may rely on third-party AI model providers, infrastructure providers, inference providers, hosting providers, storage providers, moderation providers, analytics providers, email providers, and payment providers.
12.2. These may include, without limitation:
12.3. Your use of features powered by third-party providers may be subject to their applicable terms, policies, licenses, restrictions, and acceptable use rules.
12.4. You agree to comply with all applicable third-party provider terms that apply to the features you use.
12.5. Third-party providers may change their models, APIs, pricing, rate limits, terms, safety rules, availability, retention policies, or output behavior. reviz.design is not responsible for losses, delays, output changes, feature changes, or service interruptions caused by third-party providers.
12.6. OpenAI-powered features: If a feature uses OpenAI services, you must comply with applicable OpenAI terms and policies. You may not use Outputs or the Service to develop, train, fine-tune, or improve competing AI models where prohibited by OpenAI terms.
12.7. Google Gemini-powered features: If a feature uses Google Gemini, you must comply with applicable Google terms, Gemini API terms, safety policies, prohibited use policies, and regional restrictions. You may not bypass safety systems or use the feature to develop competing models where prohibited.
12.8. xAI-powered features: If a feature uses xAI, you must comply with xAI's applicable terms and acceptable use policies. You may not misrepresent Outputs, bypass safety systems, or use Outputs to train competing AI systems where prohibited.
12.9. FLUX / Black Forest Labs-powered features: If a feature uses FLUX or Black Forest Labs models, you must comply with applicable BFL terms and policies. You may not use Outputs to train, fine-tune, distill, or improve models that compete with FLUX where prohibited. Depending on the technical route used, Inputs and Outputs may be processed under BFL's applicable terms.
12.10. Replicate-powered features: If a feature uses Replicate or models hosted on Replicate, you must comply with Replicate's terms and any model-specific additional terms or licenses. Model pages may contain additional restrictions.
12.11. fal.ai-powered features: If a feature uses fal.ai, you acknowledge that model-specific licenses may vary and that generated media URLs may be temporary or publicly accessible depending on the provider's infrastructure. You are responsible for downloading and securely storing any files you need long-term.
13.1. reviz.design does not use your User Content to train general-purpose AI models unless we clearly state otherwise and obtain any consent required by law.
13.2. We may process User Content to provide the Service, generate Outputs, maintain security, prevent abuse, debug errors, provide support, comply with law, and enforce these Terms.
13.3. Third-party providers may process Inputs and Outputs according to their own applicable terms, data processing agreements, retention policies, and service configurations.
13.4. We may use aggregated, anonymized, or de-identified usage data to analyze performance, improve reliability, monitor costs, prevent abuse, and improve the Service.

14.1. Our Privacy Policy explains how we collect, use, store, disclose, and protect personal data.
14.2. If you use the Service to process personal data on behalf of your own clients, customers, employees, tenants, property owners, real estate clients, or other third parties, you are responsible for ensuring that you have a lawful basis for such processing.
14.3. You are responsible for providing any required notices, obtaining any required consents, and complying with all applicable privacy and data protection laws.
14.4. If required under applicable data protection law, a separate Data Processing Agreement may apply.
14.5. You must not upload sensitive personal data, biometric data, health data, payment card data, government identification documents, children's data, or other high-risk personal data unless the Service expressly supports such processing and you have all required legal bases and safeguards.
15.1. reviz.design may store Inputs, Outputs, previews, logs, metadata, billing records, support records, abuse-prevention records, and technical cache data for limited periods.
15.2. Retention periods may vary depending on the feature, plan, provider, legal obligation, security requirement, or operational need.
15.3. Unless otherwise stated, generated files and uploaded files are not guaranteed to be stored permanently.
15.4. You are responsible for downloading and backing up any Inputs or Outputs you want to keep.
15.5. reviz.design is not responsible for loss of User Content, deleted files, expired URLs, unavailable previews, or failure to download Outputs in time.
15.6. Some third-party-generated files may be accessible through temporary or public URLs. Do not upload confidential or sensitive materials unless you understand and accept the risk.
15.7. After account deletion, subscription termination, or suspension, we may delete or restrict access to User Content, subject to legal, security, billing, and compliance retention needs.
16.1. All Outputs are for conceptual, illustrative, and visualization purposes only.
16.2. Outputs may not reflect real-world accuracy, physical feasibility, construction feasibility, regulatory compliance, measurements, dimensions, lighting conditions, structural conditions, materials, costs, property condition, building permissions, zoning, safety compliance, or actual appearance.
16.3. reviz.design does not provide:
16.4. You must independently verify all Outputs before relying on them for any professional, commercial, legal, technical, construction, real estate, or client-facing purpose.
16.5. You must not represent Outputs as:

If you use Outputs in real estate listings, property marketing, client presentations, brochures, advertisements, investor materials, furniture catalogs, or product marketing, you are solely responsible for ensuring that such use is not misleading and complies with all applicable disclosure, advertising, consumer protection, platform, and professional rules.
16.7. Virtual staging, decluttering, facade changes, material changes, object removal, product placement, lighting enhancement, view enhancement, and before/after imagery must be clearly disclosed where required by law, professional rules, MLS/platform rules, or client contracts.
17.1. You may not use the Service or Outputs to:
17.2. We may investigate suspected violations and may remove content, restrict access, suspend accounts, terminate accounts, block payments, or report activity to relevant authorities or providers where appropriate.
18.1. If you believe that content hosted, generated, displayed, or made available through the Service infringes your rights or violates applicable law, you may send a notice to: contact@reviz.design

18.5. We may reject notices that are incomplete, abusive, fraudulent, or insufficient.
19.1. The Service is provided on an "as is" and "as available" basis.
19.2. We do not guarantee uninterrupted availability, uptime, error-free operation, permanent storage, or compatibility with any specific device, browser, system, provider, workflow, or file format.
19.3. The Service may be unavailable due to maintenance, outages, provider failures, cyber incidents, updates, capacity issues, legal requirements, or force majeure events.
20.1. We use reasonable technical and organizational measures designed to protect the Service.
20.2. However, no online service is completely secure.
20.3. You are responsible for securing your own devices, accounts, passwords, networks, files, and access permissions.
20.4. You must not attempt to test, scan, attack, bypass, or compromise the Service except through a written, authorized security program approved by us.
21.1. We may suspend or terminate your access to the Service immediately if:

21.3. If your account is terminated, your access to the Service, credits, files, Outputs, and account data may be disabled or deleted, subject to applicable law and retention needs.
21.4. Provisions that by their nature should survive termination will survive, including intellectual property, payment obligations, disclaimers, liability limitations, indemnification, and governing law.
22.1. To the maximum extent permitted by law, the Service and Outputs are provided "as is" and "as available" without warranties of any kind.
22.2. We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, quality, compatibility, and reliability.
22.3. We do not warrant that:
23.1. Nothing in these Terms limits liability for intent, gross negligence, injury to life, body, or health, mandatory statutory liability, or liability that cannot be excluded under applicable law.
23.2. In cases of slight negligence, reviz.design is liable only for breach of essential contractual obligations and only for typical, foreseeable damages.
23.3. To the maximum extent permitted by law, reviz.design is not liable for:
23.4. To the maximum extent permitted by law, reviz.design's total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you paid to reviz.design for the Service in the 12 months before the event giving rise to the claim.
23.5. If you use the Service for free, reviz.design's total aggregate liability shall not exceed EUR [LIABILITY CAP].
24.1. To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless reviz.design, its contractors, providers, licensors, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses arising from or related to:
24.2. You may not settle any claim in a way that imposes liability, obligation, or admission on reviz.design without our prior written consent.
25.1. If you receive non-public information from reviz.design, including technical, business, product, security, pricing, roadmap, or beta information, you must keep it confidential and use it only for the purpose for which it was disclosed.
25.2. Confidentiality obligations do not apply to information that is publicly available without breach, independently developed, or lawfully received from a third party.
26.1. If you provide feedback, ideas, suggestions, bug reports, or improvement requests, you grant reviz.design a worldwide, perpetual, irrevocable, royalty-free license to use them without restriction, attribution, or compensation.
27.1. reviz.design is not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, riots, labor disputes, internet failures, power failures, cloud provider failures, AI provider failures, cyberattacks, government actions, sanctions, legal restrictions, pandemics, or other force majeure events.
28.1. We may update these Terms from time to time.
28.2. The updated version will be posted on the website with a new "Last updated" date.
28.3. If changes are material, we may provide additional notice through the Service or by email.
28.4. Continued use of the Service after updated Terms become effective means you accept the updated Terms.
29.1. These Terms are governed by the laws of Germany, excluding conflict-of-law rules.
29.2. If you are a consumer, mandatory consumer protection laws of your country of residence remain unaffected.
30.1. If you are a merchant, business, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction is Berlin, Germany.
30.2. If you are a consumer, mandatory legal jurisdiction rules remain unaffected.
31.1. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain valid and enforceable.
31.2. The invalid provision will be replaced by a valid provision that most closely reflects the economic and legal purpose of the original provision, to the extent permitted by law.
32.1. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
32.2. We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, transfer of business, or by operation of law.
